| 幼儿园体育活动伤害问题“紧箍”着幼儿园体教融合的深入推进。运用文献资料、案例分析和统计分析方法，以新近
118 起案件的裁判文书为样本，对幼儿园体育活动伤害事故的特征、法律归责及防治对策进行研究，以期助力幼儿园体育健康
教育的长远发展。研究表明：幼儿园体育活动伤害事故具有活动内容的丰富性、过错的过失性、原因的综合性、负伤致残的高
发性、牵涉利益的多元性等鲜明特征；幼儿园对其学生负有严苛的法定职责，过错推定原则为一般归责原则；幼儿园和教育行
政部门应当统筹资源，落实做好规划体育场地设施并力保其处于安全状态，完善健康检查并做好更新记录，恪尽幼儿园教师职
责，引导家长协同配合幼儿园安全教育，推广幼儿园责任保险制度并促其法定化，研制伤害事故应急处理预案，明晰幼儿园享
有一定的追责权，增强幼儿自如应对风险的能力等对治方策。 |

| The problem of injury in kindergarten sports activities hinders the further advancement of the integration of sport and educa⁃
tion in kindergartens. The author uses the methods of literature study，case study and mathematical statistics，taking the judgment doc⁃
uments of recent 118 cases as samples，to study the characteristics，legal liabilities and prevention measures of sports injury accidents
in kindergarten，in order to promote the long-term development of kindergarten sports health education. Research shows that 1）injury
accidents in kindergarten sports activities have distinctive features such as the richness of activity content，the negligence of fault，the
comprehensiveness of causes，the high incidence of injuries and disability，and the diversity of interests involved; 2）kindergartens
have strict legal responsibilities for their students，and the principle of presumption of fault is the basic principle of imputation; 3）kin⁃
dergartens and the education administrative departments shall coordinate the resources and jointly implement the countermeasures for
prevention and governance，i.e. make sure the safety of sports facilities，improve health checks and keep updated records，fulfill the
duties of kindergarten teachers，guide parents to cooperate with kindergartens’safety education and promote kindergarten responsibili⁃
ties insurance system and promote its legalization. Besides，they should develop a pre-arranged planning plan for injury accidents，
clarify that kindergartens have a certain degree of accountability，and enhance children’s ability to cope with risks. |
